Instructure Summary Product Privacy Notice

Instructure, Inc. and its affiliates and subsidiaries (“Instructure,” “we,” “our,” or “us”) prepared this Summary Product Privacy Notice (“Notice”) to provide a high-level overview of our privacy practices. You can access our detailed privacy notices by clicking here.

We provide this Notice so that the end-users of our products and services (collectively, “Products”), can better understand how our Products use personal information. To learn about how personal information is processed for specific Products, please click here.

Privacy by Product

How we process your personal information depends on our relationship with you. We provide our Products to academic institutions, such as K-12 schools and higher education institutions, and companies that use our Products to amplify teaching, elevate learning, provide professional development opportunities, and improve student outcomes. In each case, we are processing your information as directed by our customers, and they are the ultimate decisionmakers about how your information is processed.  

While our customers are in control of how student, teacher, and parent information is collected, used, and disclosed through our Products, we work hard to assist their privacy compliance and make our Products privacy protective.

About our End-Users and our Products

Our Products are accessed by a diverse group of end-users depending on the role assigned to them. These end-users may include educators, school faculty, academic institutions (such as schools and universities), students, parents or guardians, school administrators, corporate employees, technology providers, and other professionals.  

If you are an end-user of a school or company that uses our Products, your organization determines how your personal information is processed. This means that your organization’s privacy policy governs the use of your personal information, even when your personal information is shared with us. This Notice is intended to provide transparency related to our privacy practices. You should also read your organization’s privacy policies.

A. Information Collection

Contact Information. When using our Products, you may provide basic contact information such as your first and last name, date of birth, gender or preferred pronouns, payment information, and account or log-in details. 

Demographics and More. Some Products may also collect additional information such as educational background (including your schools or companies), professional information, geographic information, academic content (e.g., research papers or class assignments), video images or recordings, and other information you provide. 

For example, we collect information when

  • you create an account, 
  • an organization creates an account for you in our Products, 
  • others invite you to join our Products, 
  • a school transfers data from the school’s student information systems or other systems into our Products, or 
  • when you contact or interact with us for end-user support purposes. 

Technical Information. We automatically collect certain technical information relating to your interactions with us and our Products. This can include end-user information from your actions in our Products or from the device you use to access our Products, including, browser type, settings and preferences, computer operating system, IP address, domain name, web pages visited, web page clicks, device type, and time and date of visit, location, and other information we collect using cookies and similar technologies.  

 

B. Information Use

We use your personal information as directed by your organization and to provide, analyze, and improve our Products, and we may use information that has been de-identified or aggregated without limitation. 

These uses include the following:

  • Create and maintain your Product account.
  • Identify you as an end-user.
  • Create and assign support tickets.
  • Provide, operate, maintain, and improve our Products.
  • Personalize and improve your experience.
  • Contact you and communicate with you, including to respond to your comments or inquiries.
  • Provide customer support.
  • Request your feedback about our Products, including by asking you to respond to surveys or questionnaires (with your permission).
  • With your consent, or as otherwise disclosed at the time information is collected.  

C. Information Sharing

We may share the information we collect with other permitted entities, including the following:

  • With commonly owned entities, including companies under common ownership or control of Instructure to help provide our Products.
  • With third-party service providers who process personal information on our behalf to provide you with our Products, such as data hosting services.
  • Pursuant to a subpoena, court order, governmental inquiry, or other legal process or as otherwise required by law, to protect our rights (including the right to enforce the Instructure Acceptable Use Policy and other applicable policies) or the rights of third parties, or to protect the safety or security of any person or entity.
  • With your consent or as otherwise disclosed at the time of data collection or sharing.

D. Disclosure of Information through Our Products.  

Some of our Products have features that share information (including personal information) with authorized third parties or that allow you to share information with third parties or the public.  You can learn more about our specific Products and how personal information may be disclosed through those Products here.

Analytics

Instructure uses certain third-party services to improve the performance of our Products for analytics.  Your browser may offer tools to limit the use of cookies or to delete cookies; however, if you use these tools, our Products may not function as intended.

Artificial Intelligence

Privacy for Children

Some of the end-users of our Products may be classified as “children” under certain laws. For users of certain Products, we may take steps intended to comply with the Children's Online Privacy Protection Act (“COPPA”). Please see our Children’s Online Privacy Protection Act Privacy Notice. If you learn that a child under thirteen years of age has provided us with personal information in a manner not authorized by their K-12 school, please alert us at privacy@instructure.com.

Third-Party Links and Tools

Our Products may contain links to third-party websites or services (websites or services that are not operated by Instructure) that allow you to leave our Products and go to an outside website when you click on such a link. Your information, including personal information, may be collected by those separate entities. We have no control over, do not review, and cannot be responsible for these outside websites or their content.

Please be aware that this Notice, and our other Privacy Notices, do not apply to these outside websites or content, or to any collection of personal information after you click on links to these outside websites. The links to outside websites or locations are for your convenience and do not signify our endorsement of such third parties or their products, content, or websites.

Security of Your Personal Information

The security of our end-user’s personal information is very important to us. We take reasonable steps to help protect your personal information to prevent unauthorized access, use, or disclosure of your personal information. Despite these measures, you should know that we cannot fully eliminate all security risks associated with personal information. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee absolute security. Any content you post or input you provide while using our Products is at your own risk.

Please be aware that the personal information we collect may be transferred to and maintained on servers or databases located outside your county, and personal information may be accessible to law enforcement and national security authorities in those jurisdictions.

Changes to this Notice

We may change this Notice from time to time. If we make any changes to this Notice, we will change the “Effective Date” above. If such changes are material, a notice of the changes will be posted along with the revised Notice. We encourage you to visit this page from time to time for the latest on our privacy practices.
